A preliminary hearing was held Tuesday morning in Okmulgee County District Court for defendant Kobe Kevon Daniels, who has been charged in the July shooting death of Kobe Haynes.
A preliminary hearing was held Tuesday morning in Okmulgee County District Court for defendant Kobe Kevon Daniels, who has been charged in the July shooting death of Kobe Haynes.
The Honorable Judge Deborah Reheard handled the proceedings.
Daniels is being held in the Okmulgee County Jail, charged with First Degree Murder in Haynes’ death.
Daniels was present in the courtroom for the preliminary represented by his attorney Stephen Lee, as well as Okmulgee County District Attorney Carol Iski representing the State in the case.
Haynes’ girlfriend at the time of the incident, Alison Austin, was the sole witness at the preliminary hearing and gave her testimony as to what she recalled of the events on July 16.
Following Austin's testimony, a surveillance video from the Pit Stop gas station was viewed.
Daniels’ attorney asked that the State of Oklahoma decrease the charge from First Degree Murder to Manslaughter in the First Degree due to the lack of proof that there was any forethought in the shooting.
District Attorney Iski argued that while no proof exists that forethought took place prior to the victim and suspect arriving at the scene, surveillance video showed the suspect continuing to show threatening actions toward the victim.
Iski also argued that prior to Daniels firing his weapon, Haynes had returned his weapon to his vehicle and had turned his back on Daniels.
Daniels will return to Okmulgee County District Court before the Honorable Judge Pandee Ramirez on Dec. 15 at 1:30 p.m.
