A Henryetta man was arrested after a vehicle accident near an Okmulgee convenience store.

According to an affidavit, on May 23 at approximately 2:50 p.m., officers were dispatched to Love’s Travel Stop to assist with an accident which just occurred.

While en route, the officers were advised the vehicle which caused the accident had left the scene. Dispatch also advised the vehicle was dark in color.

Upon arrival, the officers observed the suspect vehicle, identified as a grey 2020 Kia Forte with a Missouri license plate, parked in the semi-truck area at the southwest end of the lot.

As an officer approached the vehicle, he observed a male, identified as 39-year-old Colby Ruth, leaning against the vehicle. According to the court document, when the officer

According to the court document, when the officer approached Ruth, he immediately detected the odor of alcohol emanating from his breath and person.

Ruth was also observed to be unsteady on his feet, had thick-slurred speech and blood-shot watery eyes and was holding the keys to the Kia Forte in his hand.

The officer asked if Ruth would be willing to submit the field sobriety test and was told ‘yes’ by Ruth.

After reportedly failing the test, Ruth was taken into custody and was placed in the back of the patrol car at which point a search of the vehicle was performed.

Officers found a bottle what they observed to be vodka sitting in the center console with the lid off.

Ruth was taken to the Okmulgee County Jail and was booked in on complaints of Driving Under the Influence, Transportation of a Container and Leaving the Scene of an Accident Involving Damages.

He is being held on a $15,500 bond and will return to Okmulgee County District Court on July 16 at 2 p.m. before Judge Pandee Ramirez.
